Governor Walz, in Executive Order 20-56, has declared a peacetime emergency in the City of Saint Paul as well as the City of Minneapolis and the surrounding communities. Currently, just over 292,000 Ramsey County residents have received at least one vaccine dose, however, 32% of the population has not received any doses of the vaccine. During the course of the Declared Emergency, I have issued several Executive Orders, two of which expire on August 15, 2020: I, Melvin Carter III, Mayor of the City of Saint Paul, on August 22, 2020, pursuant to Saint Paul Legislative Code Section 13.06, do hereby issue the following Executive Order: On March 15, 2020, I issued an Emergency Declaration in response to the COVID-19 pandemic pursuant to Minn. Stat. On May 28 -31, 2020, the civil unrest in Minneapolis spread to Saint Paul and included fires, looting and other criminal behavior causing significant damage. WHEREAS, on March 15, 2020, I declared under the authority given in Minnesota Statutes 12.29, that a local emergency existed within Saint Paul, effective March 15, 2020, with all the powers and responsibilities attending thereto as provided by Chapter 12, Minnesota Statutes, and Saint Paul Legislative Code, Chapter 13; and, WHEREAS, on June 8, 2020, I declared under the authority given in Minnesota Statutes 12.29, that the local emergency continued to exist within Saint Paul, effective June 8, 2020, with all the powers and responsibilities attending thereto as provided by Chapter 12, Minnesota Statutes, and Saint Paul Legislative Code, Chapter 13; and, WHEREAS, on September 8, 2020, I declared under the authority given in Minnesota Statutes 12.29, that the local emergency continued to exist within Saint Paul, effective September 8, 2020, with all the powers and responsibilities attending thereto as provided by Chapter 12, Minnesota Statutes, and Saint Paul Legislative Code, Chapter 13; and, WHEREAS, on November 30, 2020, I declared under the authority given in Minnesota Statutes 12.29, that the local emergency continued to exist within Saint Paul, effective November 30, 2020, with all the powers and responsibilities attending thereto as provided by Chapter 12, Minnesota Statutes, and Saint Paul Legislative Code, Chapter 13; and, WHEREAS, on March 1, 2021, I declared under the authority given in Minnesota Statutes 12.29, that the local emergency continued to exist within Saint Paul, effective March 1, 2021, with all the powers and responsibilities attending thereto as provided by Chapter 12, Minnesota Statutes, and Saint Paul Legislative Code, Chapter 13; and, WHEREAS, on June 1, 2021, I declared under the authority given in Minnesota Statutes 12.29, that the local emergency continued to exist within Saint Paul, effective June 1, 2021, with all the powers and responsibilities attending thereto as provided by Chapter 12, Minnesota Statutes, and Saint Paul Legislative Code, Chapter 13; and, WHEREAS, on August 31, 2021, I declared under the authority given in Minnesota Statutes 12.29, that the local emergency continued to exist within Saint Paul, effective August 31, 2021, with all the powers and responsibilities attending thereto as provided by Chapter 12, Minnesota Statutes, and Saint Paul Legislative Code, Chapter 13; and, WHEREAS, on November 29, 2021, I declared under the authority given in Minnesota Statutes 12.29, that the local emergency continued to exist within Saint Paul, effective November 29, 2021, with all the powers and responsibilities attending thereto as provided by Chapter 12, Minnesota Statutes, and Saint Paul Legislative Code, Chapter 13; and, WHEREAS, on January 3, 2022, I declared under the authority given in Minnesota Statutes 12.29, that the local emergency continued to exist within Saint Paul, effective January 3, 2022, with all the powers and responsibilities attending thereto as provided by Chapter 12, Minnesota Statutes, and Saint Paul Legislative Code, Chapter 13; and, WHEREAS, the COVID-19 pandemic continues to present unprecedented and rapidly evolving challenges to our City. Executive Order 2020-3 extending Emergency Pandemic Leave and allowance for negative accrual of ESST to non-union employees. Executive Order 2021-39 (Face covering requirement indoors at City-controlled facilities). The COVID-19 Delta variant has been determined by the CDC to be a variant of concern due to its high transmissibility and continues to account for a large number of new cases sequenced in Minnesota and Ramsey County, thereby substantially increasing the potential risk of infection and the spread of the virus through the community. 12.31, Subd. OFE may enter into an agreement with a third-party to complete this study. On March 15, 2020, I issued an Emergency Declaration in response to the COVID-19 pandemic pursuant to Minn. Stat. Pursuant to Chapter 13 of the Saint Paul Legislative Code, this Executive Order is in immediate effect upon my signature and, if not sooner rescinded or later extended, shall expire at the end of forty (40) days after its effective date or at the end of the declared local emergency to which it relates, whichever occurs first. WHEREAS, serious threats to health and safety of persons and other impacts of the COVID-19 pandemic continue to be felt in the City. This civil unrest, including looting and the destruction of property, spread to Saint Paul on May 28, 2020. Prior to providing any Assistance to Governmental Units, City departments are directed to submit for approval by me or my designee and City Council approval a written agreement outlining the assistance to be provided to the governmental unit consistent with Minn. Stat. All Businesses: Strongly encouraged to continue to require that all individuals, regardless of vaccine status, wear a face covering indoors at all times when social distancing of at least 6 feet is not maintained. Many have lost their jobs or had their hours reduced, leaving the businesses with less capacity to implement the required changes. On May 20, 2020, the Minnesota Department of Employment and Economic Development released industry guidance which will allow bars and restaurants to safely reopen on June 1, 2020. This Declaration has now expired. Administration of a COVID-19 vaccine is a medically accepted and recommended form of prophylactic treatment that dramatically reduces the likelihood of experiencing a symptomatic SARS-CoV-2 infection, and recent studies show that available COVID-19 vaccines also reduce asymptomatic infection and transmission. Completed Vaccination Series means two weeks following completion of any CDC approved vaccination series, including: A 2-dose series of an mRNA COVID-19 vaccine (Pfizer-BioNTech or Moderna), or A single-dose COVID-19 vaccine (Johnson & Johnsons Janssen vaccine). No person shall cause a Third-party Food Delivery Platform to reduce the compensation rate paid to a delivery service driver or garnish gratuities in order to comply with the terms of this emergency executive order. The leisure and hospitality are some of the hardest hit sectors. 12.31, Subd. I, Melvin Carter III, Mayor of the City of Saint Paul, on January 20, 2022 pursuant to Saint Paul Legislative Code Section 13.06, do hereby issue the following Executive Order: WHEREAS, on March 13, 2020, Minnesota Governor Tim Walz issued Executive Order 20-10 Declaring a Peacetime Emergency and Coordinating Minnesotas Strategy to Protect Minnesotans from COVID-19 pursuant to Minn. Stat. Along University Avenue between Snelling and Lexington avenues, more than 70 businesses were hit, with more than a dozen sustaining serious fire damage. 12.29; which the City Council consented to on March 17, 2020, and which has been extended and remains in effect. On November 10, 2020, the Chair of the Skyway Governance Advisory Committee, the President of Greater Saint Paul BOMA and the President of the St. Paul Downtown Alliance met and discussed skyway use and the 7:00 p.m. closing hours. In preparation for emergencies, the City of Saint Paul and each City Department maintain a Continuity of Operations Plan and a Priority Level Workplan (collectively Emergency Plans). This Declaration has been extended and remains in effect. Minneapolis Mayor Jacob Frey and St. Paul Mayor Melvin Carter said the requirement would take effect in both cities at 5 p.m. Thursday. The Planning Administrator, through the Director of the department of planning and economic development, in continuing response to the directive in the Emergency Declaration, has advised that certain City zoning ordinances require zoning permit applicants to first obtain the consent of owners of property located near the zoning applicants property in order for their zoning applications to be considered by the City. 12.31, Subd. Executive Order 2020-10 is hereby extended, subject to the Governors Executive Order 20-99 and any other local, state or federal law impacting food and beverage service for onsite consumption. ; and. Even prior to the COVID Pandemic, according to the National Health Care for the Homeless Council, there is general consensus among public health officials, medical professionals and service providers that to reduce the incidence of hypothermia nationwide, local communities should implement effective and timely strategies to address the needs of vulnerable populations, including creating temporary homeless shelters and extending the hours of operation for existing shelters. This Order has been extended several times and remains in effect; and, WHEREAS, on March 15, 2020, I issued an Emergency Declaration in response to the COVID-19 pandemic pursuant to Minn. Stat. On May 30, the Minnesota National Guard force numbered more than 4,100 in Saint Paul and Minneapolis in order to help protect critical assets and infrastructure and assist in controlling unlawful behavior overnight. During the course of the Declared Emergency, I have issued Executive Orders relating to Food Halls, and the original basis for this order has not changed: NOW, THEREFORE, I, Melvin Carter, Mayor of the City of Saint Paul, do hereby extend the following Emergency Executive Order: Pursuant to Chapter 13 of the Saint Paul Legislative Code, the above listed Executive Order remains in effect upon my signature and, if not sooner rescinded or later extended, shall expire at the end of forty (40) days after the effective date or at the end of the declared local emergency to which they relate, whichever occurs first. Executive Order 2020-10 is extended for an additional forty days with the following additional requirement for Temporary C-19 Right of Way Obstruction Permit holders under Executive Order 2020-10: All business furniture or other property that is in the public right of way must be immediately removed if any of the following occur: All Temporary C-19 Obstruction Permits issued to will expire upon the first occurrence of 2(a) or (b), above, unless sooner rescinded by the City. No 2130, Section 9 (Special Law) which allows the City of Saint Paul to create and issue an On-Sale Intoxicating Beverage Food Hall License; and, WHEREAS, the Keg and Case Market worked with the Legislature on this request for a Special Law; and, WHEREAS, the Special Law provided that, subject to requirements, this license type may allow service and consumption anywhere within the defined premises as long as consumption of licensed beverages sold by the license holder is within a food establishment area or common areas within the licensed premises; and, WHEREAS, the Special Law required the City of Saint Paul to comply in a timely manner with Minnesota Statutes Section 645.021, which required approval by resolution of a majority vote of all members of the governing body or unit; and, WHEREAS, the Council of the City of Saint Paul considered, adopted and approved the Special Law by RES 20-133 on October 7, 2020; and, WHEREAS, an amendment to Saint Paul Legislative Code Sections 409.03 and the addition of Saint Paul Legislative Code Section 409.32 is necessary to allow the City of Saint Paul to define, create and Issue On-Sale Intoxicating Beverage Food Hall Licenses; and, WHEREAS, under Saint Paul Legislative Code Provisions contained in Chapter 409 and City Charter Chapter 6, these amendments and additions would require notice, two Council Readings, a Public Hearing and another hearing before adoption; and, WHEREAS, after adoption, the changes allowing issuance of an On-Sale Intoxicating Beverage Food Hall License would not take effect and be in force until thirty (30) days following its passage, approval and publication; and, WHEREAS, this time delay may cause businesses like Keg and Case to close permanently; and, WHEREAS, allowing for the creation and issuance of the On-Sale Intoxicating Beverage Food Hall License will support Keg and Case and other businesses working to find creative solution to help them survive the COVID situation; and.
